This Acceptable Use Policy (this "AUP") supplements and is incorporated into the Terms of Service. By using G.G. Gambit (the "Service"), you agree to comply with this AUP. Capitalized terms have the meanings given in the Terms of Service.
1. General Principles
G.G. Gambit exists to help collectors, stores, and dealers identify, organize, price, and trade physical trading cards. You may use the Service only for these purposes and in a manner consistent with applicable law and this AUP. We expect honest conduct, accurate information, and good-faith dealing with other Users.
2. Prohibited Activities
2.1 Illegal or harmful conduct
You must not use the Service to:
- Violate any applicable law, regulation, or third-party right.
- Solicit, facilitate, or engage in fraud, money laundering, terrorism financing, sanctions evasion, or tax evasion.
- Sell, offer to sell, or trade Cards that are stolen, counterfeit, prohibited from sale in your jurisdiction, or otherwise unlawful to transfer.
- Use the Service in connection with the sale or trade of any item that is not a legitimate trading card (e.g., narcotics, firearms, regulated products, sexual content, or any other prohibited item).
- Harass, threaten, defame, harm, or discriminate against any person, including based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or any other protected characteristic.
- Impersonate any person or entity, misrepresent your affiliation with any person or entity, or use a false email address or other false identifying information.
2.2 Marketplace integrity
You must not:
- Post false, misleading, deceptive, or fraudulent listings — including listings that misrepresent a Card's condition, language, edition, foil treatment, authenticity, or any other material attribute.
- Engage in shill bidding, wash trading, manipulation of pricing data, or any other practice designed to artificially inflate or depress prices.
- Solicit Users to complete transactions outside the Service for the purpose of evading platform fees, escrow protections, dispute processes, or tax reporting.
- Use multiple Accounts to circumvent fees, listing limits, reputation systems, or other Service controls.
- Refuse to honor accepted offers, ship sold Cards within the time period you represented, or otherwise breach Marketplace transactions in bad faith.
- Submit, manipulate, or solicit fake ratings, reviews, or reputation signals.
- Engage in retaliatory or coordinated abuse of the Service's reporting, dispute, or rating mechanisms.
2.3 Intellectual property
You must not:
- Upload, share, or transmit content that infringes any copyright, trademark, trade secret, right of publicity, or other intellectual property right.
- Use images or text owned by another party (including card-art holders) for commercial purposes outside the descriptive use necessary to identify physical Cards in your inventory or listings.
- Remove any copyright, trademark, or other proprietary notices from materials accessed through the Service.
2.4 Security and platform abuse
You must not:
- Probe, scan, or test the vulnerability of the Service or any system or network, or breach or circumvent any security or authentication measures.
- Use bots, scrapers, crawlers, or other automated means to access the Service except through APIs we expressly make available.
- Bypass, evade, or attempt to evade rate limits, feature gates, paywalls, tier limits, or other access controls.
- Submit content or queries designed to overload, disrupt, or degrade the Service (including denial-of-service attacks, prompt-injection attacks against AI features, and abuse of card-recognition or image-upload endpoints).
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any part of the Service.
- Introduce viruses, trojans, ransomware, spyware, or any other malicious code into the Service.
- Use scan-image upload features to send content that is not a photograph of a Card (e.g., spam, harassment, or unrelated imagery).
2.5 Account and access
You must not:
- Share your Account credentials, allow others to use your Account, or use another User's Account.
- Sell, lease, or transfer your Account to another party.
- Maintain more than one personal Account, except where expressly permitted (for example, separate personal and business roles tied to clearly distinct entities).
2.6 Communications
You must not:
- Send unsolicited or unauthorized commercial communications (spam) through the Service, including through the in-app messaging system.
- Use the Service to phish for credentials, financial information, or other personal information from other Users.
- Engage in any activity that constitutes harassment or bullying of another User, whether through messaging, ratings, reviews, or otherwise.
3. Reporting Violations
If you believe a User has violated this AUP, please report it to support@nouvos.one with sufficient information for us to investigate (Account identifiers, timestamps, screenshots, and a description of the conduct).
4. Enforcement
We investigate suspected violations of this AUP. Depending on the nature and severity of the violation, we may take any one or more of the following actions:
- Issue a private warning to the User.
- Remove or hide offending User Content.
- Restrict access to specific features (e.g., suspend Marketplace listing privileges, throttle scanning).
- Temporarily suspend the Account.
- Permanently terminate the Account.
- Cancel pending transactions and refund or hold funds in accordance with our payment processor's rules.
- Report the conduct to law-enforcement or regulatory authorities.
- Pursue civil remedies, including injunctive relief and recovery of damages.
We strive to apply enforcement actions proportionately and in good faith. We may depart from a graduated approach where conduct presents an immediate risk to the Service, other Users, or third parties.
5. Appeals
If your Account has been suspended or terminated and you believe the action was taken in error, you may submit a written appeal to legal@nouvos.one within thirty (30) days. Your appeal should include your Account identifier, the action you are contesting, and the facts supporting your position. We will review the appeal and respond within a reasonable time.
6. Changes to this AUP
We may update this AUP from time to time to address emerging risks or new features. Material changes will be communicated as described in the Terms of Service.
